- Direct procurement concerns the new scale system. According to Section 40, Subsection 2, Subsection 2 of the Act on Public Procurement and Concessions (1397/2016, hereinafter referred to as the Procurement Act), direct procurement is possible in such a way that, for technical reasons or reasons related to the protection of exclusive rights, only certain the supplier can carry out the procurement; an additional condition is that there are no reasonable alternative or substitute solutions and the absence of competition is not due to an artificial narrowing of the procurement conditions. If the direct procurement decision is appealed during the appeal period, procurement is cancelled.
