• The procurement unit Salo region's education municipality is in the process of acquiring a used bus suitable for secondary vocational education. The anticipated total value of the acquisition exceeds the law on public procurement and concession agreements (hereinafter Procurement Act) of the EU threshold value defined in § 26. The vehicle must be suitable for educational use and meet the absolute requirements set by the procurement unit for the vehicle in terms of technical features and equipment. Based on established jurisprudence the procuring entity has wide discretion when defining the object of the procurement. In principle, the procurement unit does not need to match the requirements it sets for the object of procurement with the characteristics of the products offered on the market. Suitable for educational use the availability of the bus on the market is limited, and the special needs of the purchasing unit (technical features, equipment, maintenance history and safety requirements) require a targeted purchase. According to the absolute requirements set by the procurement unit the vehicle must meet the following absolute requirements: - the car has been maintained in accordance with the importer's maintenance program.
