Description:
Statistics Finland is acquiring SAS 9.4 Serry and Workstation Licenses and SAS Viya user-specific licenses. The procurement procurement procedure is a direct acquisition above the EU threshold. Under Article 40 (1) of the Procurement Act with the terms of the contract of procurement without publishing in advance of the contract. Section 40 (2) (2) of the Procurement Act provides that the contracting entity may choose a direct procurement if only a certain supplier may carry out the procurement for a technical or exclusive right; as an additional condition It is that there are no sensible alternative or replacement solutions, and the lack of competition is not due to artificial reduction in the terms of the procurement.He 108/2016 vp (p. 134) is possible under Article 40 (2) (2) of the Procurement Act if only a certain supplier can implement procurement because competition is not a technical or exclusive reason for the protection of exclusive rights. The provision is based on public procurement and directive 2004/18/EC Directive 2014/24/EU (Procurement Directive) of Article 32 (2) (b and III to the sub -section. According to the 50 Reasoning Piece of the Procurement Directive, if the lack of competition is due to technical reasons, these reasons must be precisely defined and justified on a case-by-case basis.
