Description:
The procurement concerns the new site project of Oulu Station Center's parking garage, bus station and office premises. The procurement unit suspends procurement due to changed circumstances related to the procurement. Pursuant to Section 125 of the Procurement Act 1397/2016, procurement procedure may be suspended only for a genuine and justified reason. In legal practice and literature, the real reasons have been considered to be, among other things, that:• an essential error has been detected in the procurement procedure, and the error cannot be corrected otherwise than by suspending the procurement and starting a completely new bidding process• all bids exceed the predefined budget• the circumstances related to the procurement have changed• no competition occurred because only one bid in accordance with the request for bids was received or only one application for participation. Due to the reasons presented above, there is a justified reason as defined by the legislation. The solution does not have a discriminatory effect on candidates/tenders.
